The validity of such will be dependant on the parties' domicile and habitual residence, which are difficult questions of Law to be determined. Once the marriage has come to an end if there are any children their future need have to be determined. In fact both parents can apply for either a residence order so that the child stays with them or contact order i.e. Visiting rights at agreed times.
